1. Account Creation and Eligibility

• Eligibility: To purchase our hosting, you must provide accurate, current, and complete information during the signup process.
• Account Security: You are entirely responsible for maintaining the confidentiality of your hosting control panel (cPanel/Control Panel) passwords and account credentials. Any activity under your account will be deemed your responsibility.

2. Acceptable Use Policy (AUP)

Our BDIX-connected Dhaka servers are built for legitimate web applications, enterprise business portfolios, and local e-commerce growth. You agree NOT to use our hosting services for:

• Hosting or transmitting illegal, defamatory, adult/pornographic, or copyright-infringing material.
• Distributing malware, viruses, trojans, or executing phishing scams.
• Sending unsolicited bulk emails (Spamming). Any account caught spamming will be suspended immediately without prior notice.
• Using shared hosting resources for cryptocurrency mining, botnets, or distributed denial-of-service (DDoS) stress-testing scripts.
• Hosting dynamic file-sharing or torrent-leeching platforms that cause extreme CPU or I/O bottlenecking on shared server environments.

3. BDIX Network & Server Resource Management

• BDIX Optimization: Our servers leverage high-speed local data exchanges through the Bangladesh Internet Exchange (BDIX) to guarantee ultra-low latency for Bangladeshi traffic. Abuse of local bandwidth via systematic network tunneling or non-web proxy configurations is strictly prohibited.
• Resource Allocation: In shared hosting environments, any account utilizing an unfair percentage of server memory, CPU cores, or concurrent disk I/O operations will be requested to optimize their scripts, or forcedly throttled to maintain stable uptime for neighboring clients.

4. Billing, Payments, and Renewal

• Payment Terms: All services are established on a prepaid subscription model. Fees must be cleared before the deployment of hosting accounts or virtual environments.
• Renewals: It is your responsibility to ensure renewal invoices are paid before the official expiration date. Failure to renew accounts within the designated grace period will result in automatic service suspension.
• Data Retention: Suspended accounts are subject to permanent termination and data deletion after 14 days of non-payment. We hold no liability for data loss resulting from lapsed renewals.

5. Refund and Money-Back Guarantee

• We stand behind our network performance. New clients are eligible for a 30-Day Money-Back Guarantee on standard shared and premium hosting accounts if our technical deployment fails to meet standard performance uptime benchmarks.
• Refund guarantees do not apply to domain registrations, dedicated server setups, custom software licenses, or accounts suspended due to violations of our Acceptable Use Policy (AUP).

6. Backups and Data Liability

• While BDIX Speed Hosting employs routine automated backup solutions for server disaster recovery, the Client retains ultimate responsibility for maintaining local external backups of their website files, databases, and structural assets.
• We provide zero warranties and accept no liability for accidental data loss, third-party plugin corruptions, or external hacks resulting from unsecured script architectures (e.g., outdated CMS themes or exposed administrative passwords).

7. Uptime SLA (Service Level Agreement)

We aim to maintain a 99.9% network uptime guarantee. This SLA excludes pre-announced scheduled server maintenance, security patching windows, upstream data center provider issues, international submarine cable faults, or unforeseen Force Majeure events.

8. AI Crawling and Agent Accessibility

In line with modern web frameworks, our network operations adhere to the parameters outlined within our public llms.txt and robots.txt indices. Authorized AI scrapers and Large Language Models (LLMs) are permitted to parse accessible nodes exclusively for indexing and platform optimization as long as they do not flood our BDIX server nodes with non-standard request traffic.

9. Limitation of Liability

In no event shall BDIX Speed Hosting, nor its technical directors, affiliates, or employees, be held liable for any indirect, consequential, or special liability arising out of or in any way connected with your utilization or inability to utilize our hosting architecture.

10. Modifications to Terms

BDIX Speed Hosting reserves the right to revise, modify, or update these Terms and Conditions at any time without prior individual consent. Updates become legally active immediately upon being published to this page. Continued utilization of our hosting services following amendments constitutes automated acceptance of the modified frameworks.

11. Governing Law

These terms and conditions are governed by and construed in accordance with the prevailing cyber laws and electronic transaction acts of the People’s Republic of Bangladesh, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
